A barrier-island city with rules that are still moving
Folly Beach is its own city, with City Hall at 21 Center Street. The homes range from small beach cottages to large new elevated construction, and the biggest single-address question right now is short-term rental eligibility, which is being rewritten as this guide is published. Flood elevation, lot standards, and paid parking also shape what ownership looks like.
Rental rules are in flux
Voters approved a cap on short-term rental licenses in February 2023 and the City keeps a waitlist. Live 5 News reported that a judge struck down the 800-license cap and the registration fee, and that council advanced a rewrite on September 15, 2026. Get the current status in writing before you rely on rental income.
Flood and elevation
Confirm the flood zone, the elevation certificate, and the freeboard requirement in Chapter 152 of the City code. Live 5 News reported a Community Rating System Class 3 rating and freeboard of 4 feet above base flood elevation; verify both against the code and the City.
Standards by zoning district
Height is 34 feet above the first living floor in RSF, RTF, MR, DC, IC, and MC districts, and 24 feet in RMF and CC. Residential lot coverage is 35 percent of high ground. RSF and RTF setbacks are 10 feet front, 5 to 10 feet side, and 10 feet rear.
Parking is part of ownership
The City runs a pay-to-park system and Charleston County operates a beach park with 225 parking spaces. Ask how parking rules apply to the specific street.
Short-term rentals: what to confirm
The City’s license-cap page describes the 2023 referendum and a waitlist. Since then, Live 5 News reports a court decision striking the 800-license cap and the registration fee, and a September 2026 council vote advancing a rewrite that drops the fee but keeps the moratorium and waitlist. A city-commissioned study is reported due around December 2026. Because the legal status is fluid, ask the City in writing whether a license exists for the address, whether it transfers to a buyer, and where a new applicant would stand.
Building and flood rules
- Get the elevation certificate. It shows the lowest floor elevation relative to base flood elevation and drives insurance pricing.
- Substantial improvement. Ask how Chapter 152 applies to a renovation, an addition, or storm repair on an older cottage.
- Zoning district first. Height, coverage, and setbacks vary by district, and older lots may not meet current standards. Confirm before you plan an addition or rebuild.
- State beachfront rules. Oceanfront and near-oceanfront parcels may fall under S.C. DES beachfront jurisdiction, which adds permits and setback lines.
Sand, the beach, and the pier
The U.S. Army Corps of Engineers Charleston District awarded an $18 million contract in December 2023 for about 1.3 million cubic yards of sand on Folly Beach, including dredging the Folly River channel and placing material on Bird Key. The Corps described it as fully federally funded and targeted completion before the 2024 peak hurricane season. Renourishment cycles repeat, so ask about the beach’s recent history for the specific block.
Charleston County Parks operates the beach park, and the County-run Folly Pier extends about 1,049 feet with no lifeguards; fishing fees and hours change by season. The City maintains several smaller parks, a dog park called the Bark Park, and the Karen Stringer Dock.

Monthly medians move with the mix of homes that sold, so treat any single month as a signal, not a value. Not an appraisal or price opinion for any property.
Utilities and evacuation
The City has a water, sewer, and septic page, but the provider was not clear from the material we reviewed, so confirm the utility and any septic system for the address. Folly Beach is in zone A on the state’s evacuation map. The 2026 S.C. Emergency Management Division annex lists Charleston County Zone A clearance times of about 10.1 to 11.4 hours across its modeled scenarios.
How the property tax rate works in South Carolina
The S.C. Department of Revenue’s property-tax manual says an owner-occupied legal residence is assessed at 4 percent of fair market value, while other real property, including second homes and vacant land, is assessed at 6 percent. The 4 percent rate does not transfer automatically on a sale: the new owner applies to the county assessor, generally before the first penalty date in January. Ask the county assessor how this applies to your situation.
Questions to answer before you choose
- What is the written status of any rental license for this address, and does it transfer?
- What does the elevation certificate show, and what are the flood and wind quotes?
- Which zoning district applies, and do the height, coverage, and setback standards allow your plans?
- What water, sewer, or septic arrangement serves the property?
- How do parking rules and beach access work on this street?
Common questions
Can I use a Folly Beach house as a short-term rental?
It depends on the address and the current rules. A license cap, waitlist, and court decision are all in play. Get the City’s written answer for the specific property.
Does Folly Beach have a flood-insurance discount?
Live 5 News reported a Community Rating System Class 3 rating, which carries a 35 percent discount in mapped zones. Confirm the current class and what applies to the address with the City and an insurance agent.
Is Folly Beach the same as James Island?
No. Folly Beach is its own city. Folly Road connects it to James Island, but jurisdiction, rules, and flood exposure differ.
